Terms of Service
In effect since
The short version: your records are yours, the price is one flat amount for the district, you can leave whenever you like, and the Helper is a fast way to read your own manuals — not an engineer. The rest is the detail behind those four sentences.
1.The agreement
These terms are the agreement between AguaKeep and the district or organisation using the service. By signing up, or by using AguaKeep at all, you accept them. If you are agreeing on behalf of a district, you are saying you are allowed to. If you do not agree, do not use the service.
2.Accounts and your crew
You need to be 18 or older to hold an account. Give us real contact details and keep them current, because that is how we reach you about your data.
Your district is responsible for what happens under its accounts. A crew that signs in with a shared district code is sharing one key — if someone leaves, a manager should change the code. Tell us promptly if you think an account or a code has been misused.
3.What the service is
AguaKeep records your equipment, jobs, schedules, and notes; searches the manuals you upload; and emails a summary of what is overdue and what is due soon. It reads no sensors and controls no equipment. It does not decide anything on your behalf, and it will not stop a pump from failing — it tells you what your own records say is due.
4.The Helper is not an engineer
The Helper answers from your manuals, your notes, and your job history, and shows the page or entry each answer came from. It is a fast way to find what your documents already say. It is not professional, engineering, safety, or regulatory advice.
Check the cited page before you act on an answer, especially where safety, pressure, electrical work, water quality, or a permit is involved. Software makes mistakes, and so do the manuals it reads. Your district stays responsible for the safety of its work and for meeting every rule that applies to it.
5.Your records stay yours
Everything you put into AguaKeep — equipment, jobs, notes, photos, manuals — belongs to you. You give us only the permission we need to run the service: to store it, index it, search it, back it up, and show it to the people in your district.
You can export it as plain spreadsheets from the Team page at any time, and you can ask us to delete it. What we do with it is set out in the privacy policy.
6.The manuals you upload
When you upload a manual, you are telling us you are allowed to — that you own it, or the licence you have covers using it inside your own organisation. We store it, index it, and show it back to your district only. We do not publish it, share it with other districts, or sell it.
7.What you may not do
- Break the law with it, or use it to harm someone.
- Try to reach another district’s data, or any part of the system you were not given.
- Upload malware, or anything designed to break the service.
- Scrape it, resell it, or run it as a service for someone else without our agreement.
- Overload it deliberately, or work around the limits that keep it up for everyone.
8.Trials, price, and payment
A new district can start a free trial. When the trial ends, the service continues only if you have agreed a price with us. The price is one flat amount for the district — not per person and not per pump — and it is quoted to you before you owe anything.
There is no setup fee and no contract term: you can stop whenever you like. If we ever change your price, you get notice before it applies, and stopping is always an option.
9.Availability and changes
We work to keep AguaKeep up, but we do not promise it will never be down — maintenance, outages at the companies that host it, and plain bad luck all happen. Features may change as the product improves. If we remove something your district depends on, we will say so first.
10.No warranty
The service is provided as it is. To the extent the law allows, we make no warranties about it — not of merchantability, fitness for a particular purpose, or non-infringement — and we do not warrant that it will be uninterrupted, error-free, or that every answer it gives will be correct.
11.Limitation of liability
To the extent the law allows, AguaKeep is not liable for indirect, incidental, or consequential losses — including lost revenue, lost data, or equipment damage — arising from your use of the service.
Our total liability for any claim is limited to what you paid us in the twelve months before it arose. Some places do not allow limits like these, in which case they apply to you only as far as the law permits.
12.Ending it
You can stop using AguaKeep at any time and ask us to delete your district’s data. We can suspend or close an account that breaks these terms or does not pay, and except in a clear-cut case we will tell you what is wrong first and give you a chance to fix it.
If AguaKeep itself ever shuts down, you get notice, and the export keeps working right up to the last day the service runs.
13.Changes to these terms
When these terms change, the date at the top changes with them. If a change materially affects your district, we will email the managers before it takes effect. Continuing to use the service after that means you accept the new version.
14.Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and any dispute belongs in the state or federal courts sitting there. If a court finds one part of these terms unenforceable, the rest still stands.
15.Contact
Questions about these terms go through the contact form and reach a person at AguaKeep.
